1. Information on the collection of personal data

(1) In the following, we inform you about the collection of personal data when using our website. Personal data is all data that can be related to you personally, e.g., name, address, email addresses, user behavior.

We delete the data arising in this context once it is no longer necessary to store it, or restrict its processing if statutory retention obligations apply.

3. Collection of personal data when visiting our website

HubSpot is an integrated software solution that we use to cover various aspects of our online marketing. This includes, among others:

Email marketing, social media publishing & reporting, reporting, contact management (e.g., user segmentation & CRM), landing pages, and contact forms.

Our signup service allows visitors to our website to learn more about our company, download content, and provide their contact information and other demographic information. This information, as well as the content of our website, is stored on servers of our software partner HubSpot. It may be used by us to get in touch with visitors to our website and to determine which of our company's services are of interest to them. All information collected by us is subject to this privacy policy. We use all information collected exclusively to optimize our marketing measures.

Personal data will be retained for as long as is necessary to fulfill the purpose of processing. The data will be deleted as soon as it is no longer required to achieve the purpose. In the course of processing via HubSpot, data may be transferred to the USA. The security of the transfer is ensured through so-called standard contractual clauses, which guarantee that the processing of personal data is subject to a level of security equivalent to that of the GDPR. If the standard contractual clauses are not sufficient to establish an adequate level of security, your consent in accordance with Art. 49(1)(a) GDPR may serve as the legal basis for the transfer to third countries.

On this website, we use the services of Usercentrics. The service is operated by Usercentrics GmbH, Sendlinger Straße 7, 80331 Munich, Germany. Usercentrics is a consent management service. Usercentrics is used to obtain the consent required under data protection law. In this context, the following data is processed:

The legal basis for processing is Art. 6(1)(c) GDPR. The processing is necessary for compliance with a legal obligation (obtaining and managing data protection consents).

The data (consent and withdrawal of consent) will be stored for as long as is necessary for the processing — this is usually three years.

5. Note on external links

As a content provider, branchly GmbH is responsible under the general laws for the “own content” made available for use at www.branchly.io in accordance with Section 7(1) of the Telemedia Act (TMG). A distinction must be made between this own content and cross-references (“links”) to content provided by other providers. By providing the cross-reference, branchly GmbH makes available “third-party content” that is identifiable by a URL in the browser address bar that is not branchly.io. These third-party contents were checked at the time the link was first set to determine whether they might trigger any civil or criminal liability. However, it cannot be ruled out that the content may subsequently be modified by the respective providers. branchly GmbH does not continuously monitor the content to which it refers in its offering for changes that could give rise to new liability. If you believe that the linked external pages violate applicable law or otherwise contain inappropriate content, please let us know. 6. Note on the form on our website

We use the HubSpot service to provide the online form below. To do so, we forward your data to HubSpot, which processes the data exclusively on our behalf. See the privacy policy on “HubSpot”.

Please note: If you contact us via contact forms, personal data may be transferred to service providers in third countries. These third countries do not have an adequate level of data protection. If the data is transferred to the USA, there is a risk that your data may be processed by US authorities for control and surveillance purposes without you possibly having legal remedies. The security of the transfer is regularly ensured through so-called standard contractual clauses, which guarantee that the processing of personal data is subject to a level of security equivalent to that of the GDPR. If the standard contractual clauses are not sufficient to establish an adequate level of security, your acknowledgement of this privacy policy within the context of the contact forms shall be deemed consent within the meaning of Art. 49(1)(a) GDPR, which justifies a transfer of data to any third country.

7. Notes on chat and website search

On our website, we use the search and the AI chatbot from branchly GmbH (Am Kartoffelgarten 14, 81671 Munich; hereinafter “branchly”). We have concluded a data processing agreement with branchly in accordance with Art. 28 GDPR.

Additionally, a randomly generated session ID is created each time the chatbot is used, in order to manage the chat history and enable conversation. The session ID is tied to the respective browser session or website visit. It is deleted when the browser tab or browser is closed, and regenerated on a subsequent visit when the chat is used. The session ID cannot be used to identify you or analyze your usage behavior. It also does not enable tracking across browsers, devices, or sessions.

We store chat histories for a period of 24 months. Provided you do not enter personally identifying data into the chat, we have no way of associating chat content with you.

The legal basis for data processing is your and our legitimate interest in using the chatbot pursuant to Art. 6 para. 1 lit. f GDPR, § 25 para. 2 no. 2 TDDDG.

8. Miscellaneous

It should be noted that with regard to data transmission over the internet (e.g. when communicating by email), secure transmission cannot be guaranteed. Sensitive data should therefore either not be transmitted at all or only via a secure connection (SSL).
